(1) Employees will be appointed on the basis of their educational qualifications, training and experience.
(2) Notwithstanding anything written in sub-section (1), in the case of posting from the sixth level to the seventh level, the employees who have obtained the prescribed educational qualifications for the seventh level and who have worked in the geographical area will be given priority for posting.
(3) Employees who have been designated in accordance with sub-section (1A) of section 5 and who have received designation on the basis of promotion or level matching in accordance with this Act shall be adjusted and posted in accordance with sub-section (1) of section 8.
(4) Notwithstanding anything written elsewhere in this section, only those employees who have received the minimum educational qualification or training for the fourth level will be appointed to that level.
(5) According to clauses (b) and (c) of sub-section (1) of section 8 of the Act, adjustment of employees based on performance and experience evaluation shall be done on the basis of the following merit order:-
(a) on the basis of seniority from among the employees who have been upgraded or matched at the respective level and have attained the prescribed educational qualification,
(b) If there is no educational qualification as mentioned in clause (a), on the basis of seniority among the employees who have obtained the prescribed educational qualification for the post or level that is currently upgraded or one level below the level with which the level is matched,
(c) If there is no educational qualification as mentioned in clauses (a) and (b), on the basis of seniority among the employees who have received the certificate as determined by the Ministry,
(d) If there is no educational qualification or training as per clauses (a), (b) and (c), on the basis of seniority at the level currently employed,
(6) Other arrangements related to posting shall be as prescribed.
